The Supreme Court has unanimously dismissed an application filed by Blue Gold Bogoso Prestea Limited and its partner, Future Global Resources (FGR) Bogoso Prestea Limited, seeking to overturn a High Court decision that affirmed Heath Goldfields Limited’s acquisition of the Bogoso-Prestea Mine.

The five-member panel, comprising Justices I.O. Amadu Tanko (presiding), Prof. Henrietta Mensa-Bonsu, Yonny Kulendi, H.A. Kwofie and P. Bright Mensah ruled on Tuesday, November 18, 2025 that the application brought by way of certiorari was without merit.
The mining companies had asked the apex court to quash a March 20, 2025 ruling by the Commercial Division of the High Court, which dismissed their judicial review application challenging the Minister for Lands and Natural Resources’ decision to terminate their mining rights in September 2024.
They also sought an order directing the High Court to assume jurisdiction and determine their earlier application.
But after examining the filings, the Supreme Court held that the request lacked any legal basis.
“Having reviewed all the processes filed, we do not think this application has any merit in law. We consequently do not invite the Interested Parties to respond. The application is accordingly dismissed. We make no order as to costs,” the Court stated.
Tuesday’s decision marks the sixth consecutive legal defeat for FGR and Blue Gold since September 2024, when the Minister for Lands and Natural Resources revoked their mining leases and approved their transfer to Heath Goldfields Limited.
The companies first filed a suit in December 2024, seeking to quash the Minister’s termination and prevent Heath Goldfields from taking control of the mine.
However, on March 20, 2025 Justice Yaa Onyameye Gyakobo, sitting as an additional High Court judge, struck out their claims as “incompetent” and “improperly grounded.”
The Supreme Court’s latest ruling further consolidates Heath Goldfields’ legal position and affirms the government’s stance on transparent and accountable management of the country’s mineral resources.
Heath Goldfields Ltd., now cleared of major legal challenges, says it remains committed to the responsible operation of the Bogoso-Prestea Mine, supporting national economic growth, investing in host communities and maintaining open engagement with stakeholders.
