Afenyo- Markin: Sammy Gyamfi has been duly served with my writ

Solicitor for the plaintiff in a defamation suit against the Acting Chief Executive Officer of the Ghana Gold Board (GoldBod), Samuel Adu Gyamfi, has rejected claims that his client, Osahen Alexander Afenyo-Markin, is avoiding service of the writ.

In a statement issued on behalf of Mr. Afenyo-Markin, the solicitor said the writ, filed at the High Court in Accra on August 24, 2026, had already been served on a law firm that had earlier indicated that it had Mr. Gyamfi’s authority to accept service on his behalf.

The statement said on August 26, 2026, Ayine & Partners wrote to the Registrar of the High Court, informing the court that it had the “express instructions and authority” of Mr. Gyamfi to accept service of the writ.

According to the solicitor, a bailiff of the court subsequently served the writ on the law firm.

It said, however, that Mr. Gyamfi’s lawyers returned the writ to the court registry the following day, August 27, claiming that their client had changed his mind about accepting service through them.

The solicitor further alleged that when the bailiff subsequently attempted personal service on Mr. Gyamfi at his office, he refused to accept the writ and instructed his security personnel to remove the bailiff from the building.

The solicitor dismissed as legally misconceived claims circulating on social media that Mr. Afenyo-Markin was himself avoiding service of the writ.

“It therefore cannot be the Plaintiff who is avoiding service of the writ on the Defendant as alleged on social media,” the statement said.

The solicitor argued that under Ghanaian civil procedure, it is the court registry that has responsibility for serving a defendant with a copy of a writ after it has been issued upon the plaintiff’s application.

It further relied on Order 7, Rule 12(2) of the High Court (Civil Procedure) Rules, 2004 (C.I. 47), arguing that service is valid where a writ is delivered to a lawyer who has undertaken in writing to accept service on behalf of a client.

“Accordingly, Mr. Sammy Gyamfi has been validly served,” the solicitor maintained.

The statement urged persons circulating contrary claims to desist, saying the relevant correspondence and the bailiff’s official record would establish what transpired.

It said Mr. Gyamfi, having had his lawyers accept the writ, was now fixed with knowledge of the action and was required to enter appearance and file his defence before the court.

The statement did not include a response from Mr. Gyamfi or his lawyers to the allegations concerning the attempted personal service.
