
Former Attorney-General and lawyer for suspended Chief Justice, Gertrude Torkornoo, Godfred Dame has said the processes and procedures followed in the removal of Torkornoo from office are “heavily flawed”.
Dame noted that the procedures used are in violations of the 1992 constitution.
The Supreme Court on Wednesday, May 28, 2025 unanimously dismissed the injunction application filed by Chief Justice Gertrude Torkornoo against her removal from office.
The apex court ruled that there was no merit in the application, TV3’s Laud Adu-Asare who was in court reported.
Speaking to journalists after the court’s ruling, Godfred Dame said he was not surprised by the decision of the court as the processes right from the onset have not been in tangent with the constitution.
He insisted that he is “quite surprised that the Supreme Court will be more or less acceding to repatriation of such violations against the high judicial office holder.”
“Well, not surprising because really it follows in the theme of what we have been witnessing, but we move on. There’s a lot of battles we can fight, we think that the process is flawed, no doubt. Heavily flawed, leading with all kinds of constitutional violations,” he told journalists.
The former Attorney-General believes that the matter is currently not about Justice Torkornoo but the independence of the Judiciary, hence a the ‘legal gymnastics’ is not needed.
“The proper thing must be done.
“It is not about Justice Torkornoo as I keep saying, the issues are far reaching and actually impeach on matters which affect the independence of Ghana’s Judiciary and the security of tenure of Judges and all,” he stated.
Godfred Dame noted that posterity will expose the consequences of whatever procedures being used to remove Justice Torkornoo from office.
“But if the Supreme Court for whatever reason does not seem to take that view, so be it. I think that in future the whole nation will get to know the consequences of this,” he asserted.
