
The Supreme Court has dismissed a preliminary objection filed by the Attorney-General, which sought to exclude Justices Scott Pwamang, Adibu-Asiedu, and other committee members from a suit filed by suspended Chief Justice Gertrude Torkonoo challenging the constitutionality of the proceedings against her.
The objection, argued by Deputy Attorney-General Dr. Justice Srem-Sai, claimed that the committee members were not explicitly named as defendants intended to be affected by the legal action.
However, former Attorney-General Godfred Yeboah Dame, representing Torkonoo, countered that the reliefs sought directly involved the committee members, warranting their inclusion.
A five-member panel, chaired by Acting Chief Justice Paul Baffoe-Bonnie, sided with Dame’s argument and ruled that the committee members will remain parties to the ongoing case.
Justice Torkonoo is also requesting the court to allow her to waive her right to an in-camera hearing, declare the committee’s prima facie finding unconstitutional, and bar the committee from proceeding further.
The injunction application is part of a broader suit seeking constitutional interpretation of the process being used for her removal.
