
In a bold and unprecedented legal move, the Chief Justice of Ghana, Her Ladyship Justice Gertrude Araba Esaaba Sackey has filed a motion at the Supreme Court, seeking to halt the operations of a presidential committee probing her alleged misconduct.
The suit, numbered J8/113/2025, was officially filed at 3:00 p.m. on Wednesday, May 21, 2025 at the Supreme Court.
The case lists the Attorney-General as the lead Plaintiff, alongside Justice Gabriel Scott Pwamang and Justice Samuel Kwame Adibu-Asiedu – ironically two members of the very committee under contention.
Also named as respondents are former Auditor-General Daniel Yao Domelovo, Major Flora Bazwaanura Dalugo and Professor James Sefah Dzisah.
The motion is an application for an interlocutory injunction, seeking urgent court orders to restrain the committee set up by the President from proceeding with its inquiry.
The Chief Justice argues that any further steps by the committee would prejudice her rights and the constitutional process.
Specifically, the application requests;
- An order restraining the committee, composed of the 2nd to 6th defendants, from taking any action related to the alleged establishment of a prima facie case against her, until the final determination of the suit;
- An order barring Justices Pwamang and Adibu-Asiedu from participating in the committee’s proceedings due to potential conflict of interest;
- An order suspending the operation of a presidential warrant – reportedly issued under Article 146(10) of the 1992 Constitution – that calls for her suspension from office;
- Any further reliefs the Court deems appropriate.
The motion was filed on behalf of the Chief Justice by Godfred Yeboah Dame, Ghana’s former Attorney-General, through his private law firm Dame & Partners.
The Supreme Court is expected to hear the application in the coming days.
