Justice Dennis Dominic Adjei (Sir Dennis), a Supreme Court Judge has outdoored his latest book on International Human and People’s Right: Law and Practice.
The 968-paged-book covers both international and regional human rights, how they are applied, among others.
Its aim is to bring simple understanding among legal professionals, court officials, Judges, law students on the significance of the African Charter on Human and Peoples’ Rights and others.
It treats topics such as the types of rights, talks about the European Convention on Human Rights, inter-American Commission on Human rights, International Criminal Court and Convention on the Elimination of All forms of Discrimination against Women.
The book also discusses the role of the African Court in upholding human rights for member states.
Justice Adjei explained that the African Court was established to ensure member states, uphold the principles laid out in the African Charter on Human and Peoples’ Rights.
He emphasized that, the Court helps to harmonize national legal systems with continental human rights standards describing the book as an invaluable resource that would enhance administration of justice.
He said before a case could be brought to the African Court, all available legal remedies at the local level must be exhausted, as outlined in the court’s protocols.
Justice Adjei cautioned against using “common sense” to interpret human rights treaties in domestic courts, stressing that judges must apply the law accurately to avoid going “off track”.
Justice Adjei also advised Ghanaian authorities to consider making formal reservations to specific provisions of international treaties during the ratification process if the country does not want to be bound by them, citing an example of a treaty that contradicts Ghanaian custom on the adoption of surnames.
He stated that his inspiration for writing the book was driven by his belief in upholding the rule of law, the need to align national laws with the international human rights law commitments and his experience on the bench particularly at the African Court on human and peoples’ rights.
He said the book’s significance in enhancing accessible justice and that the national legal system is consistent with their international obligations.
The book seeks to advocate legal reforms and for judges to be guided by laws not personal beliefs or opinion.
The occasion was also used for the reintroduction of three authoritative revised editions authored by the Judge including the Alternate Dispute Resolution co-authored with Justice (Rtd) Barbara Ackah-Yensu.
Justice Adjei is a Supreme Court Judge in Ghana and serves as a judge for the African Court on Human and Peoples’ Rights.
