
The Africa Institute on Governance and Security (AIGS) has expressed deep concern over the ongoing process to remove the Chief Justice of Ghana, Her Ladyship Justice Gertrude Torkornoo.
President Mahama on April 22, 2025 suspended the Chief Justice following consultations with the Council of State after which a prima facie case was established against the Chief Justice.
The President also established a five-member committee in compliance with Article 146(6) of the Constitution to inquire into the petitions which have been referred to them.
AIGS in statement on April 23, 2025 called for an impartial investigation into the petitions against the suspended Chief Justice and urged stakeholders to ensure a fair hearing in the process.
“We call on all stakeholders, including the Presidency, the Council of State, and relevant authorities, to ensure that the allegations against the Chief Justice are thoroughly and impartially investigated, with full respect for her right to a fair hearing. The process must be transparent, evidence-based, and aligned with constitutional standards to avoid perceptions of politicization or erosion of judicial autonomy,” Executive Director of AIGS, Dr Palgrave Boakye-Danquah noted.
While recognizing the constitutional provisions under Article 146 of the 1992 Constitution for addressing matters of judicial accountability, AIGS urged government to ensure that all actions strictly adhere to due process, transparency, and the rule of law.
AIGS noted that the independence of the judiciary is a cornerstone of democratic governance and a critical safeguard for the rights and liberties of all citizens, therefore, any process to remove a sitting Chief Justice must be “conducted with the utmost integrity, free from political interference, and in a manner that upholds public confidence in Ghana’s democratic institutions.”
AIGS reaffirmed its commitment to promoting good governance, accountability, and the rule of law across Africa.
“We urge all parties to prioritize the national interest and uphold the principles of justice and fairness in this critical matter,” the statement added.
